CAN SPAM ACT stands for Controlling the Assault of Non-Solicited Pornography And Marketing Act.

It is a law set for sending the commercial electronic mails by the President of United States in 2003 to give the recipients right to stop the sender from sending junk e-mail. The Federal Trade Commission (FTC) enforce this law for the citizens of America.

CAN SPAM ACT applies on the bulk emailing as well as on all the commercial mails.

So, how one can recognise a mail as commercial email?

A commercial mail is an electronic mail which is sent for commercialising, advertising or for publicity of a product.

Violation of this act cause penalties such as probation, house arrest and fines.

However, this law is not so much complicated to follow, it just requires some points to remember while emailing such as follows:

  1. Do not use misleading headers: 

Headers such as “TO:”, “FROM:” , your domain name and all contacting information must be true.

  1. Never use misleading Subject line:

Your subject line should be accurate and to the point. You cannot use subject as “You have left your key”, this is wrong.

  1. Mention your physical address:

Always tell your recipient about your location by writing your valid postal physical address in your email.

  1. Unsubscribe option:

Give your recipients the choice of not getting emails from you in near future by providing a unsubscribe button. The recipients have the right to opt out from your emails anytime.

  1. Honour recipients choice:

When a recipient opt-out from your subscription or do not want any more mails from you in future, then you should respect his choice and this should be done within 10 days of request.

  1. Always monitor your work:

It is always the duty of the owner to monitor the work going on his behalf in the company. It is legally the user responsibility to take the charge of any email marketing actions done on his behalf.

  1. Tell if it is a ad:

Tag your email with advertisement tag if its a advertisement. It is the right of the recipient to know about the emails he/she is receiving.
